These Terms of Service govern your use of Our Folio (the “Service”) operated by TurnPointLabs (the “Company”). By using the Service, you agree to these terms.
1. Service
Our Folio is a private media sharing service that lets users upload photos and videos, add optional metadata such as captions, tags, dates, and location, choose a visibility scope, and view shared memories on phones, tablets, and TV devices.
2. Accounts
You are responsible for safeguarding your account and for any activity under it. You must provide accurate information and keep it up to date.
If you use a third-party sign-in method such as Apple or Google, that provider’s terms and privacy practices may also apply.
3. Your content
You retain ownership of the photos, videos, captions, tags, profile information, and other content you upload or create. You grant us a limited, worldwide, non-exclusive license to host, store, process, transcode, cache, transmit, and display your content only as needed to operate, protect, and improve the Service according to your selected visibility settings.
Video and image files may be converted into thumbnails, previews, streaming formats, or other technical variants so the Service can provide faster loading, big-screen playback, and storage efficiency.
4. Sharing and visibility
Content is shown according to the visibility scope you choose, such as private posts or posts shared with selected groups. Group members may be able to view content and related metadata while they have access to that group.
You are responsible for confirming that you have the right to share the people, places, and media shown in your content.
5. Acceptable use
You may not upload unlawful, abusive, exploitative, harmful, or infringing content; violate another person’s privacy or publicity rights; attempt to access content outside your authorized scope; reverse engineer or disrupt the Service; or use the Service to send spam or malicious code.
We may hide or remove content, restrict features, suspend accounts, or preserve information when reasonably necessary to enforce these terms, protect users, investigate abuse, or comply with law.
6. Plans and limits
Free and paid tiers may differ by post limits, items per post, video duration, storage or processing behavior, and original-quality playback. The current limits are enforced by the Service and may be shown in the app or on the pricing page.
Paid plans are governed by the Subscription Terms. If a subscription ends or a plan changes, some uploads, original-quality playback, or other paid features may become unavailable, but your existing content remains subject to the Service’s retention and deletion rules.
7. Account deletion
You may request account deletion in the app. When a deletion request is submitted, content is hidden immediately where technically supported, and the account is scheduled for permanent deletion after the stated grace period. You may cancel the deletion by signing back in during that period.
8. Service changes and availability
We may add, change, suspend, or discontinue features, integrations, supported devices, or technical processing methods. We try to keep the Service reliable, but interruptions, data processing delays, storage provider issues, or network failures may occur.
9. Disclaimers and liability
The Service is provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, consequential, special, or punitive damages, loss of profits, or loss of data.
Nothing in these terms limits rights that cannot be limited under applicable law.
10. Changes
We may update these terms. Material changes will be notified in the app, on the website, or by email where appropriate. Continued use after changes take effect means you accept the updated terms.
